Der Schutz Ihrer persönlichen Daten ist uns ein besonderes Anliegen. Diese Datenschutzerklärung klärt Sie über die Art, den Umfang und Zweck der Verarbeitung von personenbezogenen Daten (nachfolgend kurz „Daten") innerhalb unseres Onlineangebotes und der mit ihm verbundenen Webseiten, Funktionen und Inhalte sowie externen Onlinepräsenzen, wie z.B. unser Social Media Profile, auf (nachfolgend gemeinsam bezeichnet als „Onlineangebot"). Terminology used

„Personenbezogene Daten" sind alle Informationen, die sich auf eine identifizierte oder identifizierbare natürliche Person (im Folgenden „betroffene Person") beziehen; als identifizierbar wird eine natürliche Person angesehen, die direkt oder indirekt, insbesondere mittels Zuordnung zu einer Kennung wie einem Namen, zu einer Kennnummer, zu Standortdaten, zu einer Online-Kennung (z.B. Cookie) oder zu einem oder mehreren besonderen Merkmalen identifiziert werden kann, die Ausdruck der physischen, physiologischen, genetischen, psychischen, wirtschaftlichen, kulturellen oder sozialen Identität dieser natürlichen Person sind.

„Verarbeitung" ist jedes mit oder ohne Hilfe automatisierters Verfahren, ausgeführter Vorgang oder jede solche Vorgangsreihe im Zusammenhang mit personenbezogenen Daten. Der Begriff reicht weit und umfasst praktisch jeden Umgang mit Daten.

„Pseudonymisierung" steht für die Verarbeitung personenbezogener Daten in einer Weise, dass diese Daten ohne Hinzuziehung zusätzlicher Informationen nicht mehr einer spezifischen betroffenen Person zugeordnet werden können, sofern diese zusätzlichen Informationen gesondert aufbewahrt werden und technischen und organisatorischen Maßnahmen unterliegen, die gewährleisten, dass die personenbezogenen Daten nicht einer identifizierten oder identifizierbaren natürlichen Person zugewiesen werden.

„Profiling" meint jede Art der automatisierten Verarbeitung personenbezogener Daten, die darin besteht, dass diese personenbezogenen Daten verwendet werden, um bestimmte persönliche Aspekte, die sich auf eine natürliche Person beziehen, zu bewerten, insbesondere um Aspekte bezüglich Arbeitsleistung, wirtschaftliche Lage, Gesundheit, persönliche Vorlieben, Interessen, Zuverlässigkeit, Verhalten, Aufenthaltsort oder Ortswechsel dieser natürlichen Person zu analysieren oder vorherzusagen.

Als „Verantwortlicher" wird die natürliche oder juristische Person, Behörde, Einrichtung oder andere Stelle, die allein oder gemeinsam mit anderen über die Zwecke und Mittel der Verarbeitung von personenbezogenen Daten entscheidet, bezeichnet.

„Auftragsverarbeiter" eine natürliche oder juristische Person, Behörde, Einrichtung oder andere Stelle, die personenbezogene Daten im Auftrag des Verantwortlichen verarbeitet.

Relevant legal bases

In accordance with Art. 13 DSGVO, we inform you about the legal basis of our data processing. Addition for payment data

Data transfer to third countries

Sofern wir Daten in einem Drittland (d.h. außerhalb der Europäischen Union (EU) oder des Europäischen Wirtschaftsraums (EWR)) verarbeiten oder dies im Rahmen der Inanspruchnahme von Diensten Dritter oder Offenlegung, bzw. DSGVO verarbeiten. Inhalt des Newsletters: Wir versenden Newsletter, E-Mails und weitere elektronische Benachrichtigungen mit werblichen Informationen (nachfolgend „Newsletter") nur mit der Einwilligung der Empfänger oder einer gesetzlichen Erlaubnis. Wir nutzen auf Grundlage unserer berechtigten Interessen (d.h. Interesse an der Analyse, Optimierung und wirtschaftlichem Betrieb unseres Onlineangebotes im Sinne des Art. 6 Abs. 1 lit. f. DSGVO) die Dienste der Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, („Google").

Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Wir nutzen das Onlinemarketingverfahren Google „AdWords", um Anzeigen im Google-Werbe-Netzwerk zu platzieren (z.B., in Suchergebnissen, in Videos, auf Webseiten, etc.), damit sie Nutzern angezeigt werden, die ein mutmaßliches Interesse an den Anzeigen haben. Dies erlaubt uns Anzeigen für und innerhalb unseres Onlineangebotes gezielter anzuzeigen, um Nutzern nur Anzeigen zu präsentieren, die potentiell deren Interessen entsprechen. Falls einem Nutzer z.B. Anzeigen für Produkte angezeigt werden, für die er sich auf anderen Onlineangeboten interessiert hat, spricht man hierbei vom „Remarketing". Zu diesen Zwecken wird bei Aufruf unserer und anderer Webseiten, auf denen das Google-Werbe-Netzwerk aktiv ist, unmittelbar durch Google ein Code von Google ausgeführt und es werden sog. In dieser Datei wird vermerkt, welche Webseiten der Nutzer aufgesucht, für welche Inhalte er sich interessiert und welche Angebote der Nutzer geklickt hat, ferner technische Informationen zum Browser und Betriebssystem, verweisende Webseiten, Besuchszeit sowie weitere Angaben zur Nutzung des Onlineangebotes.

Ferner erhalten wir ein individuelles „Conversion-Cookie". Die mit Hilfe des Cookies eingeholten Informationen dienen Google dazu, Conversion-Statistiken für uns zu erstellen. Wir erfahren jedoch nur die anonyme Gesamtanzahl der Nutzer, die auf unsere Anzeige geklickt haben und zu einer mit einem Conversion-Tracking-Tag versehenen Seite weitergeleitet wurden. Wir erhalten jedoch keine Informationen, mit denen sich Nutzer persönlich identifizieren lassen.

User data is processed pseudonymously within the Google advertising network. I.e. Google does not store and process e.g. the name or email address of the users, but processes the relevant data cookie-related within pseudonymous user profiles. I.e. from Google's perspective, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymization. The information collected about the users is transmitted to Google and stored on Google's servers in the USA.

Bing Ads

Wir setzen innerhalb unseres Onlineangebotes auf Grundlage unserer berechtigten Interessen (d.h. Interesse an der Analyse, Optimierung und wirtschaftlichem Betrieb unseres Onlineangebotes im Sinne des Art. 6 Abs. 1 lit. f. DSGVO) das Conversion- und Tracking-Tool „Bing Ads" der Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA, ein. Dabei werden von Microsoft Cookies auf den Geräten der Nutzer gespeichert, um eine Analyse der Benutzung unseres Onlineangebotes durch die Nutzer zu ermöglichen, sofern Nutzer über eine Microsoft-Bing-Anzeige auf unser Onlineangebot gelangt sind (sog. „Conversion-Messung"). Microsoft und wir können auf diese Weise erkennen, dass jemand auf eine Anzeige geklickt hat, zu unserem Onlineangebot weitergeleitet wurde und eine vorher bestimmte Zielseite (sog „Conversion Seite") erreicht hat. Wir erfahren dabei nur die Gesamtzahl der Nutzer, die auf eine Bing Anzeige geklickt haben und dann zu der Conversion Seite weitergeleitet wurden. Es werden keine IP-Adressen gespeichert. Es werden keine persönlichen Informationen zur Identität der Nutzer mitgeteilt.

Online presence in social media

We maintain online presences within social networks and platforms in order to be able to communicate with the customers, interested parties and users active there and to inform them about our services there.

We would like to point out that user data may be processed outside the European Union. This may result in risks for the users, because it could, for example, make it more difficult to enforce the rights of the users. With regard to U.S. providers that are certified under the Privacy Shield, we point out that they thereby commit themselves to comply with the data protection standards of the EU.

Furthermore, user data is usually processed for market research and advertising purposes. For example, usage profiles can be created from the usage behavior and resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside the platforms that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on the users' computers, in which the usage behavior and interests of the users are stored. Furthermore, data may also be stored in the usage profiles regardless of the devices used by the users (especially if the users are members of the respective platforms and are logged in to them).

The processing of users' personal data is based on our legitimate interests in effectively informing users and communicating with users pursuant to Art. 6 para. 1 lit. f. DSGVO. If users are asked by the respective providers for consent to data processing (i.e. declare their consent, e.g. by ticking a checkbox or confirming a button), the legal basis for processing is Art. 6 (1) lit. a., Art. 7 DSGVO.

Also in the case of requests for information and the assertion of user rights, we point out that these can be asserted most effectively with the providers. Only the providers have access to the users' data and can take appropriate measures and provide information directly. If you still need help, you can contact us.

Security measures

We take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk in accordance with Article 32 of the GDPR, taking into account the state of the art, the costs of implementation and the nature, scope, circumstances and purposes of the processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons.

The measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as the access, input, transfer, safeguarding of availability and its separation. Furthermore, we have established procedures to ensure the exercise of data subjects' rights, deletion of data, and response to data compromise. Furthermore, we already take the protection of personal data into account during the development and selection of hardware, software and processes, in accordance with the principle of data protection through technology design and through data protection-friendly default settings (Article 25 of the GDPR).

Product or order evaluations

In order to maintain our service quality and the quality of the products offered, we try to collect feedback from the customer after a business case has been completed. This is done in the context of the respective business case and is to be seen as a downstream process to business case processing.

Server log files

We automatically collect and store information in so-called server log files, which your browser automatically transmits to us when you make requests to our website. These are:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request

This data cannot be assigned to specific persons. A combination of this data with other data sources is not made. We reserve the right to check this data retrospectively if we become aware of concrete indications of illegal use.

Data deletion

The data processed by us will be deleted or restricted in its processing in accordance with Articles 17 and 18 DSGVO. Unless expressly stated within the scope of this data protection declaration, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. I.e. the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for reasons of commercial or tax law.

According to legal requirements in Germany, the storage takes place in particular for 10 years in accordance with §§ 147 Abs. 1 AO, 257 Abs. 1 No. 1 and 4, Abs. 4 HGB (books, records, situation reports, accounting vouchers, commercial books, for taxation relevant documents, etc.) and 6 years in accordance with § 257 Abs. 1 No. 2 and 3, Abs. 4 HGB (commercial letters).

According to legal requirements in Austria, storage is carried out in particular for 7 years in accordance with Section 132 (1) BAO (accounting records, vouchers/invoices, accounts, receipts, business papers, statement of income and expenses, etc.), for 22 years in connection with real property and for 10 years for documents in connection with electronically provided services, telecommunications, radio and television services provided to non-entrepreneurs in EU member states and for which the Mini-One-Stop-Shop (MOSS) is used.

In the event of deletion by us, your data will be rendered unrecognizable and unrecoverable using an irreversible pseudonymization process.

We secure our website and other systems by technical and organizational measures against loss, destruction, access, modification and distribution of your data by unauthorized persons. You should always keep your access information confidential and close the browser window when you have finished communicating with us, especially if you share the computer with others.
